The Daniele family, who own several restaurants in western New York, are upset that an eagle nest has disrupted their plans to destroy some nice habitat to build unneeded and overpriced homes on Irondequoit Bay in Rochester, NY. They are suing New York State for $1 million. This despite the fact that they have failed to apply for permits under the state endangered and threatened species act to do work near the nesting area. Entitled rich folks suck.

Excuse me while I lower the classiness of this blog and say that those people are douchebags.
I went to the article, and I only could read the first page. I am assuming that the developers are saying that the restrictions are a state government takings.
These takings arguments have been used at the federal level with the Endangered Species Act and have lost. Hopefully the NY state courts will follow precedent and rule in favor of the eagles.

@Joseph: At the bottom of the first page you should be able to click either “2” or “next” to get you to the next page of the article. And, yes, they essentially argue that the state, by preserving the eagles’ nest, has made their land worthless, there, it has been “taken.”
We need more Eagles not more Condos–I hope the State of NY Gives them the what for about who’s rights are more important in this one! Eagles RULE-
The article brings up some interesting points. Man buys land, no eagles. Man pays taxes on land and develops a plan to build houses on it. Eagles have since taken up residence. Man is now
extremely limited on land use, but still paying taxes on original value, but land has no value now. Forget if man is rich or not. This could happen to anyone. What is a fair resolution to the man, yet protects the eagles. Based on the article several alternatives are being looked at. VERY ITERESTING CASE??
The ironic thing is that they probably want to build the houses because people like the areas close proximity to nature!! 😉
